Freelancing in Korea for overseas clients? Understand business registration, income tax filing, VAT exemption and zero-rating requirements.
Do you live in Korea and provide translation, design, development or consulting services to clients abroad? If all your clients are overseas and they pay into an overseas account, do you need to register a business in Korea?
If you are a Korean tax resident running an independent, ongoing business in Korea, you generally need to register your business with the Korean tax office. Overseas clients or a foreign bank account do not automatically remove your registration or tax filing obligations.
This guide assumes that you are a Korean tax resident and provide services independently. If your tax residence is uncertain, or you work as an employee of a foreign company, your circumstances need separate review.
The working relationship matters more than the contract title
Even if your contract calls you an independent contractor, the tax treatment may differ if the relationship operates like employment.
Relevant factors include who controls how and when you work, how closely the client supervises you, and who bears equipment costs and business expenses. Having one client or receiving a fixed monthly payment does not automatically make you an employee. The actual relationship determines how your income should be classified and reported.
Business registration does not mean incorporation
You can register as a sole proprietor without setting up a company.
What matters is the work you do, whether you operate independently, and whether you carry on the activity on an ongoing basis. Having no Korean clients, or working from home without a separate office, does not remove the registration requirement.
Apply for business registration within 20 days of starting your business. Address this when you begin, rather than waiting for your first income tax return. Income Tax Act, Art. 168; Enforcement Decree of the Income Tax Act, Art. 220; Value-Added Tax Act, Art. 8
If you are a foreign national, also check that your immigration status permits the activity. Registering with the tax office does not give you permission to work or run a business under immigration rules.
Does payment into an overseas account change your Korean tax obligations?
The location of your bank account does not, on its own, determine where the income arises.
Korean tax residents are generally taxed on income from both inside and outside Korea. A special rule applies to foreign nationals who are Korean tax residents and whose total period of domicile or place of abode in Korea is five years or less during the ten years ending on the last day of the relevant tax year. For qualifying individuals, foreign-source income is taxable in Korea only to the extent that it is paid in Korea or remitted to Korea.
That rule applies only to foreign-source income. Work performed in Korea does not become foreign-source simply because the client pays into an overseas account. What matters is what the payment is for and where you did the work. Income Tax Act, Art. 3
VAT exemption and business registration are separate questions
Some personal services provided by individuals are exempt from value-added tax (VAT) if the statutory conditions are met. A VAT exemption does not remove business registration or income tax filing obligations.
Consider these three categories:
- VAT-exempt services: Does the service, and the way you provide it, meet the exemption requirements?
- Taxable services eligible for zero-rating: Zero-rating means VAT applies at 0%. Eligibility depends on the service, customer, payment method and supporting documents. Some service categories also require reciprocal tax treatment in the customer's country.
- Other taxable services: Follow the VAT filing and payment rules that apply to your business.
A job title such as translator, designer or developer does not settle the answer. The services you deliver, your business facilities, and whether you employ staff or engage others to perform the main work can all affect the treatment. Enforcement Decree of the VAT Act, Art. 42
Working for overseas clients does not automatically make a service zero-rated. Payment must be received by one of the methods specified in the rules. If a platform handles your payments, review who sends the funds, how they reach you and the supporting records. The currency of the final payout alone does not establish eligibility. Enforcement Decree of the VAT Act, Art. 33; Enforcement Rule of the VAT Act, Art. 22
No Korean tax withheld: what should you prepare?
Even if your clients withhold no Korean tax, you may still have to file your own returns. Residents with business income generally file a Korean global income tax return in May of the following year. VAT returns, or an annual business status report for a VAT-exempt business, may also be required. Income Tax Act, Art. 70; Income Tax Act, Art. 78; NTS filing deadlines
Keep the following records from the start:
- contracts describing the work and fees
- invoices issued to clients
- bank records and platform settlement statements
- business expense records, including platform fees
- records showing when and where you performed the work
For platform payments, record client billings, fees and payouts separately.
If you have already received income without registering or filing, organise your contracts, payment records and previous returns. These are the starting point for identifying any outstanding obligations.

Frequently asked questions
Does an overseas bank account mean I do not need to file in Korea?
No. The account location alone does not determine your filing obligations. Your tax residence, the nature of the income and where you performed the work all need to be considered.
My services are VAT-exempt. Do I still need business registration?
Generally, yes, if you are running an ongoing business. A VAT exemption does not remove registration or income tax filing obligations. You should also check whether an annual business status report is required.
Are services for overseas clients automatically zero-rated?
No. Zero-rating depends on the service, customer, payment method and supporting documents. Some service categories also require reciprocal tax treatment in the customer's country.
